📜Terms & Conditions – Solité Studios

1. Scope

  1. These Terms & Conditions (T&C) apply to all orders placed via the Solité Studios online shop (physical products: clothing) for both consumers (B2C) and business customers (B2B), unless otherwise agreed.

  2. Deviating terms from the customer are not recognized unless expressly approved in writing by Solité Studios.

3. Prices and Shipping Costs

  1. All prices include statutory VAT.

  2. Shipping costs are calculated separately and displayed during the ordering process.

  3. Prices apply at the time of the order.

4. Delivery

  1. Delivery is made worldwide via DHL.

  2. Delivery time is 5–14 business days, unless otherwise stated for a specific product.

  3. If products are temporarily unavailable, the customer will be informed immediately.

  4. Risk passes to the customer once the goods have been handed over to the carrier.

5. Payment

  1. Payment methods available: Shopify Payments (credit card, Klarna, Apple/Google Pay) and PayPal.

  2. Payment is due before delivery.

  3. In case of default, Solité Studios reserves the right to take legal action.

6. Right of Withdrawal

  1. Consumers have the right to withdraw from the contract within 14 days without giving reasons.

  2. The right of withdrawal is detailed on the separate “Right of Withdrawal” page.

  3. Return costs are borne by the customer.

7. Retention of Title

Delivered goods remain the property of Solité Studios until full payment has been received.

8. Warranty / Liability for Defects

  1. Statutory warranty rights apply.

  2. Defective goods may be exchanged, repaired, or refunded at the discretion of Solité Studios.

  3. Obvious defects must be reported in writing within 14 days of receipt.

9. Liability

  1. Solité Studios is fully liable for intent and gross negligence.

  2. For slight negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations), and only for typically foreseeable damages.

  3. Solité Studios is not liable for damages resulting from improper use of the products.

  4. Liability for content on the website is limited to intentional misrepresentation.

10. Customer Account

  1. Customers may create an account and must provide accurate information and keep their password secure.

  2. Solité Studios is not liable for damages resulting from misuse of the customer account, except in cases of gross negligence.

11. Newsletter and Vouchers

  1. Customers may subscribe to the newsletter.

  2. Vouchers are non-transferable and valid for a single use only.

  3. There is no minimum order value unless explicitly stated in the voucher terms.

12. Final Provisions

  1. German law applies, excluding the UN Sales Convention (CISG).

  2. Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected.

  3. Jurisdiction for consumers is the place of residence of the customer; otherwise, Pforzheim, Germany.
